In a filing with a New York court on Nov. 25, lawyers hired by Diddy said their clients should have the freedom of speech that Trump enjoyed in a lawsuit plotting to overturn the results of the 2020 election, when thousands of supporters supported the Capitol on Jan. 6, 2021.

The lawyer cited the ruling of the District of Columbia Court of Appeals in the December 2023 lawsuit between the United States and Trump, which wrote: "Only a significant and imminent threat to the criminal justice system supports restricting Trump's speech."

At the time, the court agreed that Trump had the right to make statements against the current administration (headed by Joe Biden), the U.S. Department of Justice and special counsel, as well as declaring that the prosecution of the former president was politically motivated or that he was innocent of the charges against him.

With the above evidence, Diddy's lawyer argued that the court should apply Mr. Trump's higher standards when considering restricting the freedom of speech of the rapper born in 1969.
