Dam Vinh Hung was "greenlighted" by the federal court, billionaire Gerard lost his position

In early October 2025, the Federal Court for the Central District of California officially approved the proposal from Dam Vinh Hung, returning the lawsuit between the male singer and billionaire Gerard Williams to the state court for settlement.

The lawsuit between singer Dam Vinh Hung and businessman Gerard Williams, husband of overseas singer Bich Tuyen, in the US has just had an important development. The Federal Court for the Central District of California has just issued a decision to cancel the hearing and approve the request of plaintiff Dam Vinh Hung, returning the case to the state court for processing. This is considered a big step forward in the legal battle between the two sides.

According to legal documents, on October 31, 2024, Dam Vinh Hung filed a lawsuit against Gerard Richard Williams in state court. By 27/11/2024, the summons and lawsuit were served to the defendant. The lawsuit then gave rise to many legal moves from both sides.

On August 7, 2025, Gerard Williams filed an application to transfer the case to the Federal Court based on Diversity Jurisdiction, in order to create an advantage in the trial process. The defendant's argument is that Dam Vinh Hung is a Vietnamese citizen, and Gerard Williams is a citizen of Missouri, USA, instead of California as previously documented.

Prior to this move, on September 4, 2025, Dam Vinh Hung filed a Motion to Remand, requesting to return the lawsuit to the state court. Mr. Dam's lawyer argued that the defendant did not transfer the lawsuit on time, violating the Forum Defendant Rule, which prohibits the defendant from transferring the case to federal court if he is a citizen of the state where the lawsuit was filed. Dam Vinh Hung's side affirmed that Gerard Williams was a California citizen but falsely testified to the federal court of Missouri to circumvent the law, and at the same time provided evidence to prove the argument.

In the ensuing period, both sides defended their positions. Gerard Williams persisted in requesting a trial in federal court, while Dam Vinh Hung strengthened the legal basis, emphasizing that the transfer of the defendant's case was illegal. After careful consideration, the federal court assessed that Dam Vinh Hung's request was in accordance with federal civil procedure regulations. The trial scheduled for October 7, 2025 on arguments to return the lawsuit to the state court was canceled, and the court approved all of the plaintiffs' requests, except for costs and attorneys' fees requested by Dam Vinh Hung's side.

This outcome means that the lawsuit will be returned to the Superior Court of California, County of Orange. The federal court's legal text emphasizes the decision was made after considering all the arguments and main points presented by the parties.

This development is considered an important victory for Dam Vinh Hung. The lawsuit has received great attention due to the involvement of famous figures, financial factors and high reputation. The fact that the case was returned to the state court helped Dam Vinh Hung better control the trial process, and at the same time affirmed the application of the Forum Defendant Rule in similar lawsuits.
