Amber Heard is hoping her insurance company can "accompany" her to pay part of the compensation debt for ex-husband Johnny Depp after losing the lawsuit. However, this unit refused.
According to TMZ, Amber Heard has a $1 million legal insurance package with New York Marine and General Insurance. This amount will be paid for the buyer's risk or misconduct, including defamation.
However, under a new law of the state of California (USA), insurance companies have the right to refuse to pay if it finds that customers have committed "intentional" wrongdoing.
As for the case of the Aquaman actor, she was ruled by the Fairfax court "intentionally" and "maliciously" to defame Johnny Depp in the recent stalking lawsuit. Therefore, the insurance company is not responsible for transferring money to Heard or helping her pay off the $8.3 million debt owed to her ex-husband.
At the trial on June 1, the jury found Depp won against Heard on three counts. The actor will receive $10 million in punitive damages and $350,000 in punitive damages.
The Aquaman actor was awarded a counterclaim on one charge when a jury found that Depp's media representatives had smeared Heard and her accusations were a "violent hoax". She received $2 million in compensation. Thus, the total amount of money Heard had to pay to her ex-husband was $8.3 million.
With assets currently under $ 2.5 million, Heard is completely unable to pay the fine. In this case, the legal expert said that Heard could choose to take a cut in his current and future salary.
Elaine Bredehoft - Heard's lawyer - has previously confirmed that the actress did not pay the fine because of financial incompetence. However, Heard was still determined to appeal and win back from her ex-husband.
Amber Heard previously said the verdict "retards the notion that violence against women should be taken seriously" and will appeal. In an interview with Today channel on June 15, the actress affirmed that she did not smear Johnny Depp through an article in the Washington Post in 2018. "The article does not talk about my relationship with Johnny. I am referring to it. It's a bigger cultural problem that we have at the time. I'm clearly aware that I shouldn't reveal Depp or do anything to smear Depp," Heard said.
Reportedly, a 43-page appeal was filed by the American star in court in early July. The document claims Depp "conducted only a defamation case by implication, refuting all claims that the Miss Heard's statement is indeed false." The papers made a statement on Friday (US time).
Heard's lawyers also argued that the 15th Jury on the jury may even have been illegally selected by giving the wrong date of birth during the jury selection process - 1945 instead of the jury. The actual year is 1970.
"This discrepancy raises the question of whether the 15th Jury has actually received a summons for jury duty and has been reasonably examined by the court for jury service" - the proposal of lawyer said.
As a result of this alleged error, the legal team stated that Heard's settlement process was "compromised" and "should be declared erroneous".
"As a result, Ms. Heard's proceedings were compromised. In these cases, a false lawsuit must be declared and a new trial requested," the filing states.
The filing states that "protective measures" do not appear to have worked in this case and that the exact identity of the juror has not been verified.
Former US attorney Neama Rahmani told Fox News Digital that the charge brought by Heard's legal team "is not a basis for a mistake or for overturning a conviction."
On the other hand, Ben Chew - Johnny Depp's lawyer - said he had anticipated Amber Heard's application to cancel the sentence. "Their side just filed the application later than we thought. However, the content of the single is no big deal," Chew told Variety.
The lawsuit between Amber Heard and Johnny Depp stems from the actress's magazine article, two years after their divorce. In it, Heard called to oppose sexual violence, seeing himself as a victim of domestic violence. Although she did not directly mention Depp's name, the actor was boycotted by Hollywood and lost many projects. He sued his ex-wife for $50 million for defamation. Heard countersued, seeking compensation of $ 100 million for the same crime.
