According to the provisions of Point a, Clause 1, Article 101 of Decree No. 15/2020/ND-CP stipulating penalties for administrative violations in the fields of post, telecommunications, radio frequencies, information technology and electronic transactions, the act of "Supplying and sharing fake information, false information, misrepresenting, slandering, insulting the reputation of agencies, organizations, honor and dignity of individuals" may be fined from 10-20 million VND.

In case of sufficient constituent elements, the crime of abusing democratic freedoms as stipulated in Article 331 of the Penal Code is punishable by up to 7 years in prison.

"In fact, administrative sanctions under current regulations are still light, not ensuring general deterrence and prevention. Therefore, in my opinion, in the coming time, State management agencies need to amend this regulation to increase the level of penalties to ensure deterrence, education and prevention of violations in cyberspace.

In my opinion, management agencies need to have clear regulations, requiring service providers in Vietnam to coordinate to control information and manage behavior on social networks. Such action will help protect the legitimate rights and interests of individuals, organizations as well as the interests of the state," the lawyer shared.
