All 5 defendants were banned from leaving the place of residence. At the same time, they were all prosecuted under Clause 1, Article 318 of the Penal Code, with the maximum penalty of up to 2 years in prison.

Specifically, according to article 318, the crime of disturbing public order

Those who disturb public order, causing adverse effects on security, social order and safety, or have been administratively sanctioned for this act or have been convicted of this crime, have not yet had their criminal record expunged. but still commit the violations, the offenders shall be subject to a fine of between VND 5 million and VND 50 million, a non-custodial reform for 2 years or a prison term of between 3 months and 2 years.

According to the indictment, Trang is the owner of Trang Nemo shop at Nguyen Cu Trinh Ward, District 1, Ho Chi Minh City. Due to a conflict with Ms. Tran Nguyen Tra My in the online sales business, Trang made an appointment to meet Ms. My at the store to resolve.

Specifically, around 3 pm on January 16, 2022, Ms. My, Ms. Pham Le Khanh, Ms. Tran Thi Hoang Yen went to Trang Nemo store. Here, Ms. My and Ms. Yen entered the store to meet Trang to apologize, while Ms. Khanh stood outside. When Ms. My was apologizing to Trang, Ms. Khanh entered the store and said that Ms. My was leaving, so there was an argument with Trang. Trang used her hand to snatch Khanh's mask, and Khanh cursed at Trang.

Hearing that, Trang's staff, Quy and Trang, rushed to grab her hair and hit her head and back with her hands, and kicked Khanh's stomach with her feet. At this time, when Yen intervened, she was also beaten by Khuong.

Because they saw a fight inside the store, Phan Hoang Nam and Nguyen Phuoc Tuan (store security) went in and saw Quy, Khuong and Ms. Khanh cursing each other, angry, Nam and Tuan continued to beat her. Khanh.

According to the conclusion of the assessment, Ms. Khanh suffered 3% injuries, and Ms. Yen did not have enough evidence to determine that there was an injury. At the investigating agency, Trang Nemo, Quy, Khuong, Tuan and Nam confessed to committing the offence.

According to the People's Procuracy of District 1, this is a case with accomplices but in the case of simple accomplices. In which, Trang Nemo, Quy, Khuong, Tuan, Nam are the ones who directly committed the crime. The defendants' acts have infringed on public order and the health of others, causing insecurity and disorder to society. Therefore, it is necessary to be dealt with strictly before the law for general education and prevention.
