Miley Cyrus "confronts" Bruno Mars, makes a strong statement against plagiarism suspicions

According to court documents obtained by People, pop star Miley Cyrus' attorney dismissed the copyright infringement claim filed by Tempo Music Investments in September 2024.

Tempo Music Investments, which holds part of the copyright to Bruno Mars' song When I Was Your Man, has accuse.d the former Disney star of plagiarism in the song Flowers.

Accordingly, the singer's lawyer argued that Tempo Music Investments is not the "exclusive owner" and cannot sue for copyright infringement. After Miley's side filed a lawsuit in court, Tempo's side continued to remain silent.

However, the other co-writers of When I Was Your Man, Ari Levine and Andrew Wyatt, are not affiliated with Tempo Music Investments, and the singer's attorney argued that "only exclusive rights holders can sue for copyright infringement".

The See You Again singer's lawyer added: "The assignee is only a co-author, so he does not have exclusive rights and therefore does not have the right to sue."

Miley Cyrus' legal team asked for the lawsuit to be dismissed.

In September 2024, Tempo Music Investment filed a lawsuit in Los Angeles federal court against Miley Cyrus for "unlawfully exploiting" certain elements of When I Was Your Man. The agency said it owned part of the song after purchasing the copyright from Philip Lawrence, who co-wrote it with Bruno Mars, Ari Leviene, and Andrew Wyatt. Music publishers including Sony Music Publishing, Apple, Target, and Walmart are also named as defendants for distributing Flowers. The news agency said Bruno Mars is not a plaintiff in the lawsuit.

Temple Music argues that Flowers would not have won Record of the Year at the 2024 Grammys without Bruno Mars' song. The company argues that her work copies many of the melodies, harmonies, and lyrics — including the pitch, sequence, chord progression, and other elements of the original song. "Based on the combination and number of similarities between the two recordings, it is undeniable that Flowers would not exist without When I Was Your Man," the complaint reads.

The company also listed Cyrus' co-lyricists Gregory Hein and Michael Pollack as defendants, alleging that the three "created a derivative work of When I Was Your Man without permission."

Flowers was released in January 2023 and topped the Billboard charts for six weeks. Fans assumed it was a message from Miley Cyrus to her ex-husband, actor Liam Hemsworth, because the lyrics revolved around a woman becoming stronger after a breakup, and the song was released the day after his birthday.

After Flowers was released, Bruno Mars's old composition attracted attention due to the similarity of the lyrics between the two. When I Was Your Man is a ballad released in 2012, which entered the Billboard Ho.t 100 chart in 2013.
