In March 2015, the Shanghai Bureau of Industry and Commerce (China) announced that it would punish national MC Barbie Hsu for fraudulent advertising. The reason was that in a TV commercial for a toothpaste brand, the female artist declared: "Just brush your teeth for 1 day, your teeth will be visibly whiter", along with a picture of her bright white teeth.
However, authorities discovered that the advertisement of the toothpaste brand that Từ Hy Äá» was the spokesperson for had exaggerated its effectiveness, while in reality the product did not have the miraculous teeth-whitening effect as advertised. In addition, Từ Hy Äá»'s bright teeth were also a product of photoshop.
After discovering this consumer deception, the Shanghai Bureau of Industry and Commerce announced a fine of 6.03 million yuan (over 21 billion VND) for Xu Xi Di. This was also the highest fine at that time for a brand representative involved in violating the Advertising Law in China. On Xinhua News Agency, a representative of the Shanghai Bureau of Industry and Commerce said that China's Advertising Law clearly states that false advertising of daily-use products is not allowed. In the case of Xu Xi Di and the toothpaste brand, not only did they advertise falsely, they also deceived the audience by using edited images to fake the results of using the product.
"Toothpaste should only be advertised as making breath fresh and teeth clean, not as whitening. If the manufacturer wants to advertise teeth whitening, it must provide a conclusion from the ingredient inspection department. Therefore, Từ Hy Äá» and the brand have seriously violated the regulations. That is why we have imposed a record fine on this female artist as a deterrent," said a representative of the Shanghai Industry and Commerce Bureau.
The incident caused Từ Hy Äá»âs reputation to be ruined. The A-list MC was heavily criticized by the public. She quietly paid the fine and did not dare to make any comments about the Shanghai Bureau of Industry and Commerceâs decision to punish her for fear of public backlash. Notably, before the toothpaste scandal, Từ Hy Äá» herself was investigated and had to bow her head to apologize to the audience for being involved in an advertisement for bread products containing additives.
Previously, in October 2013, Từ Hy Äá» was summoned by the Taipei District Prosecutors' Office (Taiwan, China) to cooperate in the investigation of the Top Pot Bakery bread invested in by her husband's company - tycoon Hứa Nhã Quá»c - which was found to contain a number of additives and artificial flavors. As the brand's representative, Từ Hy Äá» was also implicated. The reason was that she had committed that Top Pot Bakery bread products were made entirely from natural ingredients. However, the test results of the Food Safety and Hygiene Department were contrary to the artist's advertisement.
According to the Consumer Protection Law in Taiwan (China), if Hsu knew in advance that Top Pot Bakery's bread contained additives and flavorings but still advertised falsely, she would be prosecuted for consumer fraud and could receive a sentence of less than 5 years in prison. If she did not know that Top Pot Bakery's products contained additives and only advertised according to the brand's requirements, she would still be fined and warned.
The scandal was so serious that it left Từ Hy Äá» withered, losing weight to only 39 kg. After that, she had to go on television to publicly apologize to the audience for her deceptive advertising.
