If the fountain is damaged and is being repaired, the homeowner should post a warning or cover it to prevent people from sitting on it, Dung Taylor analyzed.

Dung Taylor commented that from the defendant's perspective, Mr. Gerard Williams could respond that they were not the event organizer but only lent the space. "Because they only lent the space and not rented it, there would be no binding contract with the organizer. Next, the defendant only needs to provide evidence that the fountain is operating normally, not damaged at all, but the water is turned off because of fear of electrical lines or noise... And according to US law, objects under 3 feet (about 0.9 m) in height do not need to have warning signs or fences," Dung Taylor shared.

Thu Phuong's husband added: "In addition, a very important thing that Gerard Williams needs to bring up is whether Dam Vinh Hung is a guest or a contract employee. According to the California Department of Labor Code, contract employees must have occupational accident insurance. At this time, contract employees are their own employers.
