It seemed that everything had been closed after the first instance verdict, but the wife of the late actor Duc Tien suddenly released a shocking statement right after receiving the right to manage the estate. Is this statement hinting at unresolved issues?
On the afternoon of October 28, the People's Court of Ho Chi Minh City officially issued the first instance verdict, closing the inheritance dispute that attracted attention after the passing of the late talented actor Duc Tien.
First Instance Judgment and Probate
After receiving and reviewing the evidence, the Trial Panel (TP) issued a conciliatory verdict: accepting part of the plaintiff's lawsuit and at the same time accepting part of the defendant's counterclaim. The key and most important point of the verdict is the legal recognition of the will that the late actor Duc Tien made on August 9, 2023 in the US.
According to the authenticated will, Ms. Nguyen Binh Phuong was recognized as the administrator of the main estate. This property includes a house located in Hiep Binh ward, now Thu Duc city (formerly Linh Dong ward), and a plot of land in Long An province (in Duc Lap Thuong commune, former Duc Hoa district).
However, in order to ensure the rights and contributions of the late artist's mother, the panel also imposed financial obligations on Ms. Binh Phuong. Accordingly, Duc Tien's wife is responsible for returning to Ms. Nguyen Ngoc Anh a sum of 2 billion VND. This sum is considered a recognition of the mother's contributions and assets to the common inheritance, especially the house in Ho Chi Minh City, where she claimed to have a share of ownership.
Response From Plaintiff
From the US, where Ms. Nguyen Binh Phuong lives with her daughter, she expressed her agreement with the verdict of the Ho Chi Minh City People's Court. Binh Phuong shared with the press that this verdict is "reasonable" and completely in line with the wishes she has pursued since the lawsuit was initiated.
Binh Phuong emphasized her consistent stance throughout the litigation process: "From the beginning of the lawsuit until now, I have always wanted the division of assets to be carried out in accordance with current legal regulations and to ensure legitimate rights for my mother-in-law." With the verdict, she expressed her desire to end legal and family disputes, so that she can fully focus on work and take care of her young daughter, and stabilize her life after the shock of loss.
Background of the Case and Disputed Points
The case arose from the sudden death of the late actor Duc Tien in the US in May 2024. The inheritance property in dispute included two real estate items: a house and land in Ward 7, Linh Dong Ward (now Thu Duc City), and land plot No. 1841 in Duc Hoa District, Long An Province.
Initially, Ms. Nguyen Binh Phuong filed a lawsuit, based on the 2023 will, requesting the court to recognize full ownership of the two above properties.
However, Ms. Nguyen Ngoc Anh firmly opposed this request. In her counterclaim, she requested the court not to recognize the legal value of the will, on the grounds that this document "is not in accordance with Vietnamese law" in dividing assets.
Based on that, Ms. Nguyen Ngoc Anh requested the Court to recognize her ownership of 50% of the value of the house in Ho Chi Minh City. For the land plot in Long An, she requested to be divided 50% of the value, arguing that she and her eldest daughter had made great efforts in directly managing, using, paying taxes, and renovating and preserving this property during the time the late actor lived in the US with his wife since 2011.
The verdict of the Ho Chi Minh City People's Court has completely resolved these conflicts, by both recognizing the legality of the will (the wife's part) and acknowledging the mother-in-law's contribution in kind through the obligation to repay 2 billion VND. This verdict officially puts an end to the protracted legal dispute, opening up an opportunity for the late actor Duc Tien's family to stabilize their lives and fully preserve the memory of the deceased artist.
