According to lawyer Dao Thi Bich Lien, Ha Hai and Associates Law Office, arbitrarily publicizing other people's personal information and assets on social networks without their consent can seriously violate privacy rights and current legal regulations.
This behavior may be handled according to regulations on privacy infringement, administrative sanctions or criminal prosecution depending on the severity of the violation.
Pursuant to Article 21 of the 2013 Constitution of Vietnam, everyone has the right to inviolability of private life, personal and family secrets; and has the right to protect their honor and reputation.
In addition, Article 38 of the 2015 Civil Code stipulates that the collection, storage, use, and disclosure of information related to private life and personal secrets must be agreed upon by that person. The collection, storage, use, and disclosure of information related to family secrets must be agreed upon by family members, unless otherwise provided by law.
According to Clause 1, Article 101 of Decree 15/2020 (amended by Clause 37, Article 1 of Decree 14/2022), the act of posting personal information on social networks without consent may be subject to administrative penalties.
Specifically, a fine of 20-30 million VND will be imposed for disclosing personal confidential information that is not yet criminally liable. The violating information will be removed if requested by the authorities.
If the act of posting personal information on social networks causes serious consequences, the perpetrator may be prosecuted under the 2015 Penal Code.
In addition, individuals whose honor, dignity, and reputation are violated by posting defamatory information on social networks may request compensation for damages under Articles 584, 585, and 592 of the 2015 Civil Code on damages caused by infringement of honor, dignity, and reputation. These include: reasonable costs to limit and remedy the damage; actual lost or reduced income; and other damages as prescribed by law.
