Specifically, "sincere confession" is understood as the offender honestly confessing the entire nature of the case, helping the investigation agency quickly clarify the criminal act. Meanwhile, "repentance" is an attitude showing remorse, the desire to correct mistakes and remedy the consequences. The prosecution agency will assess the level of voluntary cooperation and the attitude of the defendant in declaring to decide on the application.

Regarding the circumstance of "voluntarily repairing, compensating for damages or remedying consequences", the resolution also expands the scope of application. Accordingly, not only the offender directly compensates, but also if the defendant agrees to let relatives or others remedy the damages on his behalf, the sentence will still be considered for a reduction.

The circumstance of "the offender has excellent achievements in studying and working" only applies to individuals who have certificates of merit, medals, honorary titles of the State or equivalent to the Prime Minister or higher. Meanwhile, the content of "having many charitable contributions" - if there is no official recognition or reward document - will not be considered as an independent mitigating circumstance, although charitable acts can still be considered as a supporting factor in the process of personal assessment.
